The company (hereinafter referred to as SOMATEX®) makes this website available to its customers and interested parties.


2. Fundamental principles

SOMATEX® takes the protection of personal data very seriously and strictly adheres to data protection legislation in the Federal Republic of Germany, the German Telemedia Act (Telemediengesetz) and the data protection provisions of the European Union.

SOMATEX® likewise requires its employees to comply with the same obligation. Under no circumstances is the collected data to be sold or disclosed to third parties without the prior express consent of the individual concerned, unless SOMATEX® is ordered by the authorities or the courts to disclose specific data.

3. Collection of personal data

To enable access to the services it offers, SOMATEX® collects, processes and uses the following data:

  • Your first name and surname or the first name and surname of the person acting on behalf
  • The e-mail address you use to register
  • Delivery address
  • Telephone number in case of queries while the order is being processed
  • Credit card or account data if you opt for credit card or direct debit payment (cf. Paragraph 4.4).

 Such data is hereinafter referred to as “personal data”.


4. Purpose behind the collection, processing and use of personal data

4.1 Unless otherwise expressly stated in these data protection provisions, SOMATEX® collects, processes and uses personal data solely to process orders. The processing of an order entails:

  • Creating a member account
  • Verifying your identity
  • Delivering the order
  • Processing payment.

4.2 In addition, SOMATEX® uses first names, surnames and personalized e-mail addresses to provide information by e-mail as follows: sending carefully selected offers for similar products from our range to the e-mail address you provide unless you have expressly objected to this. Your e-mail address is not disclosed to any other company.

You can ask for your e-mail address not to be used for marketing purposes at any time by e-mail (no particular form needs to be completed), or you can click the button “Unsubscribe from the newsletter” in any e-mail.

4.3 Where SOMATEX® is to perform services on account at your request, SOMATEX® is entitled, in order to protect its legitimate interests (in particular to protect itself against non-payment due to inability to pay), to obtain information on creditworthiness based on a mathematical-statistical process with the assistance of the credit agency Bürgel Wirtschaftsinformationen GmbH & Co KG. For this purpose, SOMATEX® transfers personal data (first name, surname, address) to Bürgel Wirtschaftsinformationen GmbH & Co KG so that a credit scoring process can be completed. SOMATEX® uses the information obtained in this way exclusively to make a carefully considered decision as to whether a change to your preferred method of payment is required. You can refuse to give your consent to a creditworthiness check at any time by writing to SOMATEX® Medical Technologies GmbH, Data Protection Officer, Hohenzollerndamm 150/151, Haus 2, 14199 Berlin, Germany or by sending an e-mail to In this case, however, SOMATEX® will not perform services in advance of payment.

4.4 To process credit card payments, we disclose payment data to our payment partner, Computop Wirtschaftsinformatik GmbH, to enable the transaction to be processed. The data is transferred using 1024-bit encryption.

4.5 Personal data is stored and processed exclusively on the servers of SOMATEX® or its service provider, Mittwald CM Service GmbH, in Germany.

4.6 SOMATEX® uses “cookies” as set forth under Paragraph 6 for the purposes of verifying your credentials to place an order with SOMATEX®.


5. Your rights / Duration of data use

5.1 SOMATEX® uses the data you provide exclusively to fulfil and process the order (Paragraph 4.1), to inform you about special offers available from SOMATEX® (Paragraph 4.2) and, if applicable, to perform a creditworthiness check (Paragraph 4.3). Express consent is always required for any other use of personal data. Whether consent is granted or refused is recorded.

5.2 You can at any time view the consent you have expressly granted and for what purposes in your personal customer account, under Personal Data. You also have the option at any time to change (i.e. to update, correct or add), delete or block the personal data that you have entered in the member area under Personal Data.

5.5 In the event that you delete your customer account or withdraw your consent, your personal data will be promptly deleted. Where retention periods prescribed by law prohibit, statutes or contracts prohibit such deletion, in particular but not exclusively, to fulfil obligations arising under a contractual relationship, personal data will be blocked instead of being deleted .


6. Use of cookies

6.1 Whenever this website is accessed, cookies are used to offer you a convenient online service with rich functionality and to verify your credentials to use the services offered.
