SOMATEX® takes the protection of your personal data very seriously and strictly adheres to the regulations of the applicable data protection laws. Under no circumstances will the data collected be sold or passed on to third parties without the express prior consent of the persons concerned, unless SOMATEX® is obliged to disclose the specific data due to regulatory or judicial orders.
In the following data protection declaration, we will inform you which personal data SOMATEX® collects, processes and uses, for what purposes this is done and how you may object to certain gathering, processing or use of your personal data. Personal data is all data that can be obtained on you, e.g. name, address, email addresses, user behaviour.

B) What information do we collect from you?
In the following section, we will clarify for you what data we collect from you and the purpose for collecting the respective data. For questions, please contact firstname.lastname@example.org .
1. When Using Our Website
In the case of merely informative use of the website, i.e. if you do not register or otherwise provide us with information, SOMATEX® will only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect, among other things, the following data that is technically necessary for us to show you our website and to ensure the stability and security (Legal basis is Art. 6 (1) lit. f) GDPR):
This data is transmitted to us by your browser and stored by us in log files on secure servers for security reasons (for example for the identification of attacks) for a limited period of time. After the evaluation of this data they are regularly deleted.
In addition to the aforementioned data, cookies are stored on your computer when using our website. Cookies are small text files that are stored on your hard drive and associated with the browser you use and information is shared with the company/organisation responsible for the cookies on the site (in this case- us). Some of the cookies we use are deleted at the end of the browser session, i.e. After closing your browser (known as session cookies). 2. When Ordering Our Newsletter
a) Consent to the newsletter
By giving your consent you can subscribe to our newsletter, which will inform you about our products, updates about our company, our events and other special offers. The advertised goods and services are named in the declaration of consent.
To register for our newsletter, we use the so-called double opt-in procedure. This means that after you have registered, we will send you an email to the provided email address in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration, your information will be blocked and automatically deleted. Moreover, we store your IP addresses and the times of registration and confirmation. The purpose of this procedure is to verify your registration and, if necessary, to inform you about the possible misuse of your personal data.
The required information for sending the newsletter is your email address and your first and last name. The specification of additional, separately marked data is voluntary and will be used to contact you personally. After your confirmation, we will save your email address for the purpose of sending you the newsletter. Legal Basis is Art. 6 (1) lit. a) GDPR.
You can revoke your consent to the sending of the newsletter at any time and unsubscribe from the newsletter. You can revoke your consent by clicking on the link provided in every newsletter email, by sending an email to email@example.com or by sending a message to the contact details stated in the imprint.
b) Newsletter Tracking
The newsletters contain so-called tracking pixels. A tracking pixel is a miniature graphic that is embedded in emails that are sent in HTML format to enable log file recording and log file analysis. This allows a statistical evaluation of the success or failure of online marketing campaigns. Based on the embedded tracking pixels, SOMATEX® can detect if and when an email was opened by the person concerned and which links in the email were also accessed by the person.
Such personal data collected via the tracking pixels contained in the newsletters are stored and evaluated by those responsible in order to optimise the delivery of the newsletter and to better adapt the content of future newsletters to the interests of the person concerned. This personal data will not be disclosed to third parties. The people concerned are entitled at any time to revoke their declaration of consent. After the revocation, this personal data will be deleted by those responsible for the processing of data. A cancellation of the receipt of the newsletter automatically indicates SOMATEX® as a revocation.
c) External service provider CleverReach
We use the provider CleverReach GmbH & Co. KG to send our newsletter. CleverReach GmbH & Co. KG is a service of CleverReach Verwaltungs GmbH, Oldenburg.

3. Processing an Order
In addition to the above-mentioned data, SOMATEX® collects and processes personal data that is necessary for the processing of an order for SOMATEX® products, i.e.

After completion of the contract, your data will be blocked from further use and deleted after expiry of the tax and commercial retention periods, unless you have expressly consented to the further use of your data. Legal Basis is Art.6 (1) lit. b) GDPR. Otherwise, the legal basis is Art.6 (1) lit. a) GDPR (Consent). The legal basis for storage based on statutory retention requirements is Art. 6 (1) lit. c) GDPR.
To process payments by credit card, we pass on the credit card details to our payment partner Computop Wirtschaftsinformatik GmbH for processing.
4. Transfer of Personal Data for a Credit Check
Insofar as SOMATEX® is to make advance payments upon customer request, SOMATEX® is to safeguard legitimate interests (in particular the prevention of any insolvency-based defaults on payments) in accordance with Art. 6 (1) lit. f) GDPR and is entitled to obtain a credit rating based on mathematical-statistical procedures.
For this purpose, SOMATEX® passes the personal data (first name, surname, address) to the credit agency Auskunftei Bürgel Wirtschaftsinformationen GmbH & Co KG to carry out a credit score check. Then the information obtained is used by SOMATEX® solely for the purpose of deciding on the possible amendment of the customer's desired method of payment.
The customer may object to the conduct of a credit check at any time by notifying us by post at SOMATEX® Medical Technologies GmbH, Data Protection Officer, Hohenzollerndamm 150/151, 2, 14199 Berlin, or via email. Please note, however, that SOMATEX® will not make any advance payments in this case.
C) Google Analytics
The IP address provided by Google Analytics as part of Google Analytics will not be merged with other Google data.

D) Use of Google reCAPTCHA
When ordering our newsletter we use the reCAPTCHA service from Google. This is primarily used to distinguish whether the input is made by a natural person or is being misused by machine or automated processing. The aim is to ensure sufficient data security when submitting forms. Legal basis for the use of reCAPTCHA is Art.6 (1) lit. f) GDPR. The service includes the sending of the IP address and any other data required by Google for the Google reCAPTCHA service. For this, the different data protection regulations of Google shall apply.
